1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Art by Jaricco website (the "Site"), the sale of original paintings from the Eleanor Series, and any inquiry, VIP list, or collector correspondence with the studio. By accessing the Site or submitting an inquiry, you agree to these Terms. If you do not agree, do not use the Site or submit an inquiry.

"Art by Jaricco," "we," "us," and "our" refer to the studio operated by Jaricco. "You" refers to the visitor, inquirer, or collector.

2. The Artwork

The Eleanor Series is a closed run of twenty (20) original, one-of-one paintings. Each painting is an original work sold individually. We do not sell prints, reproductions, or editions of any kind. Once the series is sold, it is closed.

Listed prices, dimensions, and availability are presented in good faith but may change without notice. A painting is reserved or sold only when the studio confirms the transaction in writing. Until then, any inquired work may be sold to another collector without prior notice to you.

3. Purchases & Payment

Originals are available by inquiry. After you confirm a work, the studio will provide a private invoice and instructions for payment.

All sales of original paintings are final. Paintings ship within 5–7 business days, flat-rate within the continental United States. International shipping is available; duties and taxes are the buyer's responsibility. If a painting arrives damaged, email artbyjaricco@gmail.com within 48 hours with photos.

Each original carries its own certificate of authenticity issued by the studio.

4. Intellectual Property

All artwork, images, text, and design on this Site are the property of Jaricco and are protected by United States and international copyright law. Purchasing an original painting does not transfer copyright in the work or the right to reproduce, distribute, or commercially exploit the image.

You may not copy, download, reproduce, or use any image of the artwork for any commercial purpose without the studio's prior written permission. Personal, non-commercial sharing of a work you own is welcome.

5. Communications & SMS Consent

When you submit an inquiry or join the VIP list, you may provide contact information so the studio can respond to you about a painting or its availability. If you provide a mobile number and affirmatively consent, you agree that we may contact you by SMS about your inquiry and related collector communications.

SMS consent is separate and optional: it is never a condition of any purchase, and you can decline it without affecting your inquiry. Message frequency varies. Message and data rates may apply. 6. Limitation of Liability

The Site and its content are provided "as is." To the fullest extent permitted by law, Art by Jaricco is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or any artwork, image, or communication provided through it.

7. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws provisions. Any dispute arising under these Terms will be resolved in the courts located in Orange County, California.

8. Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted on this page with an updated revision date. Continued use of the Site after changes constitutes acceptance of the revised Terms.
